About the Indiana Department of Revenue (DOR):

The Indiana Department of Revenue team has over 700 staff members from 13 locations across Indiana. We work collaboratively with the Indiana Governor's office, the General Assembly, state agencies, individuals, business owners, corporations, tax practitioners, and tax program participants to administer Indiana's tax laws. About Motor Carrier Services:

The Motor Carrier Services (MCS) department manages the International Fuel Tax Agreement, International Registration Plan, oversize/overweight vehicle permitting and the issuing of U.S. Department of Transportation numbers, Unified Carrier Registration (UCR), and the licensing of passenger and household goods transportation providers.

Salary:

Salary is commensurate with education and job experience.

Role Overview:

The Senior Attorney and Hearing Officer conducts technical and legal research, addresses taxpayer issues fully and fairly, and resolves exceptions, disputes, and protests.

Examples of law matters include:

  • Fuel tax determinations, appeals, and settlements

  • Oversized vehicle civil penalties

  • Unified Carrier titles and insurance

  • International Registration Plan settlements

  • Unclaimed property claims

  • Wheel Tax and County/Municipal taxes

    This position is located in Indianapolis, IN. Employees have two virtual workdays each week. The State provides an annual allowance of $5,250 for professional development and continuing education.

A Day in the Life:

The essential functions of this role are:

  • Legal counsel on all aspects of laws, rules, regulations, etc., that affect or may potentially impact the Motor Carrier Services division.

  • Accept and fully resolve formal protests, issuing Letters of Findings, Final Order Denying Decision, and Memoranda of Decision addressing each protest or otherwise resolving protests.

  • Schedule and conduct administrative hearings.

  • Resolve all associated issues raised following issuance of the Letter of Findings including requests for rehearing, preparation, and issuance of Supplementary Letters of Finding, and settlement issues; as well as issues associated with litigation if a final determination is challenged in court.

  • Prepare and present settlement proposals.

  • Conduct site checks and second-level review of determinations as directed by the Associate General Counsel (AGC).

  • Maintain an organized Legal Services database for assigned items or ensure such items are placed in preexisting database areas.

  • Provide supplemental assistance to the AGC for any items related to the AGC’s representation position on fuel tax.

  • Lead any legislation implementation for MCS.

  • Coordinate with motor tax audit team regarding document retention, mergers, sales, etc. dealing with audits based on document retention, mergers, sales, etc.

What You'll Need for Success:

  • Must be licensed to practice law in the state of Indiana.

  • Knowledge of tax law. Experience in tax law is a plus.

  • Ability to research federal and state laws and statutes and apply them to individual cases.

  • Extensive knowledge of legal resources and research procedures.

  • Ability to engage and collaborate with other DOR departments as needed for effective decisions and resolutions.

  • Broad knowledge of legal concepts, laws, and trial rules.

  • Excellent organizational skills and detail-oriented.

  • Communicates effectively in verbal and written manner.

  • Knowledge and ability to use MS Outlook, Word, PowerPoint, Excel, SharePoint, Adobe Acrobat, Westlaw, and TEAMS.

  • Provide deliverables and meet established deadlines.

  • Perform work accurately and in a timely and effective manner.

  • Exercise a high degree of care when dealing with discretionary and confidential information.

  • Must have the ability to travel out of state, not more than four times a year.

  • Must have the ability to work at least one day a week at the Motor Carrier Services facility.

Supervisory Responsibilities/Direct Reports:

This role may provide direct supervision for one or more staff members.
