MINIMUM REQUIREMENTS:

A bachelor's degree from an accredited college or university and four (4) years of professional experience in systems analysis, management analysis, program planning, program research, program evaluation, or administrative work.

A master's degree from an accredited college or university can substitute for one (1) year of the required experience.

Professional or nonprofessional experience as described above can substitute on a year-for-year basis for the required college education.

Requires possession of a valid Class E driver license.

JOB DUTIES:

General: Performs advanced informational and educational work for the Division of Food, Nutrition and Wellness. Work involves complex evaluation, research, and independent analyses of existing program operations and activities. Conducts comprehensive preparation, coordination and dissemination of information related to federal feeding programs to contribute to the effectiveness and efficiency of the agency and its program sponsors and recipient agencies. Conducts comprehensive preparation, coordination and dissemination of Standard Operating Procedures (SOPs) for the division’s programs. Coordinates the development, analysis, implementation and documentation of guidelines, policies, procedures, rules and regulations for the serious deficiency processes, complaint investigations and appeals. Serves as the division’s alternate Rule Coordinator, alternate Civil Rights Coordinator, alternate Appeals Liaison, and alternate Forms Coordinator.

Analyzes and interprets federal regulations, program trends and operational functions to effectively plan, develop and maintain division handbooks, procedures, policy releases, rules, and other program materials. Analyzes and interprets legislation and regulations affecting division programs and drafts formal comments and/or rules for publication. Plans, develops, and coordinates program changes with division management to ensure complete and timely implementation of program rules and regulations.

Serves as a liaison with the Office of General Counsel on all program appeals. Coordinates with attorneys regarding resolution of legal issues and sufficiency of compliance with applicable federal, state, and local laws, administrative rules and regulations. Develops, organizes, and maintains tracking logs and routing control of serious deficiency and other adverse action correspondence to ensure that all documents are sound. Prepares hearing documents and concise reports with findings of fact and recommended actions. Ensures the maintenance and accuracy of the serious deficiency and other adverse action electronic files and timelines. Monitors all administrative proceedings.

Oversees the adoption of rules for the division, including preparing the proposed rule and all other documents, seeking advisement from the division program attorney and the department Rule Coordinator. When necessary, drafts any supplemental notices or other documents that may be required and holds workshops or hearings when required. Reviews and routes division forms for approval. Maintains a working relationship with the department’s Forms Coordinator to ensure the division is in compliance at all times.

Processes and tracks serious deficiency determinations, including reviewing all documentation to ensure sufficiency and monitoring administrative proceedings. Responsible for making independent determinations of serious deficiency upon recommendation from appropriate division staff. Evaluates serious deficiency trends. Develops, coordinates, and implements changes to processes, procedures, tools and training materials regarding serious deficiencies to improve efficiency, effectiveness and consistency statewide. Ensures the accuracy and completeness of the State Disqualified List.

Responds to Civil Rights complaints received by the division. Maintains and updates as needed the division’s Civil Rights Complaint Procedures in accordance with FNS 113-1. Ensures civil rights training is provided to staff and program sponsors. Develops and provides guidance to program sponsors about Civil Rights complaint procedures. Ensures complaints are forwarded to the U.S. Department of Agriculture in a timely manner. Researches, processes, and ensures final disposition of complaints referred to the division for investigation. Maintains a detailed complaint log for all complaints received. Prepares formal follow-up correspondence as necessary to explain the status of complaint resolution or action taken by the division. Ensures the most current version of the nondiscrimination statement is utilized in all division publications.

Drafts waiver requests in accordance with the statutory requirements in Section 12(l) of the Richard B. Russell National School Lunch Act (NSLA), 42 U.S.C. 1760(l) when needed. Ensures all information required by U.S. Department of Agriculture, as outlined in in Section 12(l) of the NSLA, is included in each waiver request, including submission of all required data and information. Ensures the required public notice of all waiver requests is provided in the same manner in which the department usually provides similar notices and information to the public. Consults with the U.S. Department of Agriculture Regional Office when developing waiver requests to ensure well-reasoned, thorough requests are submitted. Requests renewal of waivers after the initial waiver period has expired, if needed.

Assists with the emergency management functions of the bureau during periods of disaster. Performs other related duties as assigned.
