Job Summary

The Claims Agentis responsible for providing claims management services in order to minimize costs and losses to the Company. The incumbent investigates accidents, incidents, claims, and complaints involving third parties, injuries, and damages to property, in order to discover the facts and assess the extent of liability and the quantum. The role represents the Company at Small Claims Court and other administrative and specialized tribunals. Furthermore, the role is accountable for applying sound, current adjusting principles in dealing with claims for and against the Company as well as locating, engaging and supervising experts and independent adjusters, when required for claims handling and litigation purposes.

Main Responsibilities

· Investigate and report on risks and claims resulting from accidents and incidents involving injuries, fatalities or property damage to the Company or third parties

· Determine when the assistance of experts, appraisers, or adjusters is required as well as engage and supervise such assistance

· Negotiate with third parties, insurance companies, independent adjusters and outside counsel on the settlement of claims or recommend disposition of claims

· Keep apprised of legislation changes, case law and adjusting and insurance trends (including insurance policies) that may affect claims handling as well as changes in railway operations, procedure, and policy

· Assist and educate Company personnel in reporting accidents in a timely manner, including the necessary information required that affect the Company

· Work with Company solicitors in preparing for and during trial

· Liaise with outsourced legal counsel in preparation for and during trial

· Attend administrative and specialized tribunals as a representative of the Company, to give evidence or obtain information

· Represent the Company at Small Claims Court

· Liaise with third parties, their insurers, and their representatives, in cases where the Company may be liable for damage caused by CN's Contractors, and for which insurance coverage may be available

Working Conditions

The role has standard working conditions in an office environment with a regular workweek from Monday to Friday and is eligible to participate in CNs hybrid work policy. The role may be required to work overtime as needed. Due to the nature of the role, the incumbent must be able to meet tight deadlines, handle pressure and stress due to dealing with fatalities, serious injuries, extensive property damage and operating in an adversarial environment. The role must be available 24/7 on-call to respond to emergency situations and evacuations. The role requires minimal travel (up to 20%) within Canada and the United States (U.S.).

Requirements

Experience

Claims Handling and Adjusting

· Minimum 5 years of experience in claims handling and adjusting

Education/Certification/Designation

· High School Diploma or General Educational Development (GED)

· College Diploma*

*Any designation for these above would be considered as an asset

Technical Skills/Knowledge

· Thorough knowledge of adjusting principles, standards, and insurance policy interpretation

· Knowledge of claims management, investigative procedures, and negotiation techniques

· Sound knowledge of civil liability principles in material damage and bodily injury claims, motor vehicle accidents liability schemes, as well as some knowledge of relevant Federal, Provincial and Municipal statutes and by-laws relating to railway operation

· Knowledge of claims in the context of transportation

· Working knowledge of accounting and financial reporting for analysis of complex claims

· Knowledge, proficiency and the ability to work and learn about various computer programs including Systems, Applications and Products (SAP), Ariba, Microsoft Office, Graphic Information System (GIS), and Borealis

· Knowledge of Canadian Rail Operating Rules, CN's General Operating Instructions, safety rules and regulations*
